We will provide representation to parents at the CSE/IEP meetings to ensure that appropriate program, services and placement are offered to your child.
If you disagree with the evaluations completed by the school district, you have the right to obtain an independent private evaluation at the school district's expense. We will guide you through the process of obtaining an IEE.
If you are unable to reach an agreement with the school district regarding the program recommendation, we will file a due process complaint on your behalf to seek appropriate education and services. If the program offered is inappropriate, the parents have the right to place their kids in a private school and initiate a due process hearing to seek tuition reimbursement from the school district. We will fully guide parents in this process.
Special Education Law allows parents to file an appeal with State Review Officer (SRO) if the parents do not prevail at the due process hearings. We can file a case on behalf of the parents with the SRO or defend the case if the appeal is filed by the school district. We will represent parents in any further appeals with federal courts.
Section 504 of the Rehabilitation Act allows students to obtain reasonable accommodations or modifications to the programs. We can attend the Section 504 meetings and, in case there is a disagreement with the school district's recommended accommodations, file due process hearings to seek appropriate accommodations.
School districts are obligated to follow strict procedures under NYS Education Law 3214 before they can suspend a student. We will represent the parents and students in disciplinary proceedings to prevent suspension from school. If needed, we can challenge the suspensions further by filing an appeal with the school board and the Commissioner's Appeal with the NYS Department of Education.
